The Great Alaska Adventure team is planning a five-day fly-fishing trip for the executive team of BlueNote, Inc. at the bequest of the President. The trip will be into the remote back country of Tikchik River, an area known for its wildlife and rugged terrain.The area is best known for its salmon fishing.   The trip will be all-inclusive except that the executives will be responsible for their own transportation to the Dillingham base camp. We will need to provide transportation from Dillingham to the Tikchik River Basin, boat transportation with motors, camping equipment and meals, guides and a four-hour fishing class. We will provide fishing licenses for all the guests and four experienced river guides.DiscussionThe first thing we need to find to deal with in the planning process is to find a way to get from Dillingham to the Tikchik. Most of the time people going on float trips down the river begin by taking a float plane to the lake at the head of the river.Our first concern wi ll be the cost of renting the float plane and making certain that it has sufficient space for our guests and our equipment. We will also need to hire four experienced guides who are also adept at fly-fishing and can teach our guests how to fly fish once we get on the river.   Once we get to the river, we will be able to make the float trip in 4 to 5 days. We will plan on food for six days at minimum and also take additional equipment for immediate preparation of our catch. In case of really bad luck fishing, we will take sufficient food to take care of three meals per day for at least six days.We will also want to take water purification tablets for drinking water and snacks. The boats will then be taken to the river and we will commence our trip down the river. The first thing will be our fly fishing class and then we will have lunch. Then we will float down the river for about four hours and get to the campsite for the evening. We will make camp and begin the first evening of se rious fishing. This will be repeated for the next four days.It sounds simple and like nothing could go wrong, right? Right. Nothing. Except what if the motors on the boats don’t work,   it rains every day and the raft capsizes the first day and we lose our food. What if we encounter a grizzly who thinks our guests look like a good morning snack or one of the guests is allergic to fish?   What if they forget their hip waders and end up with hypothermia?Some of these risks we can plan for and account for and some we try to mitigate. For example, by hiring experienced guides we should be able to minimize the chance of capsizing the raft and losing our equipment. In addition, we will hire at least one, preferably two guides with extensive first aid training and survival training, so that they can deal with injuries or illness in our guests and whatever the wildlife try to thrown at us.We will precheck the equipment before leaving Dillingham to make certain that the equipment is functional. This should reduce the chance of malfunction once we get into the wilderness. In addition, we will take both cellphones and a CB radio so that we can communicate with civilization should we need immediate medical assistance.   We will carry flares and the guides will be armed with shotguns in case of an animal attack.Since we are going in June, the likelihood is that the weather will be cooperative and we should have warm enough temperatures, but we will need to consider what alternatives will be in place should the week of the trip arrive and the weather be inappropriate for a trip into the back country. For example, if we find that the entire week is expected to be rainy and cold, we need to have an alternative plan in place. What is our responsibility if the trip must be canceled due to inclement weather?

The novel ‘Chinese Cinderella’ is an autobiography written by Adeline Yen Mah, describing her childhood and younger teenage years as an unwanted daugther. Unlike most children, Adeline had a difficult time growing up. All throughout her life she was bullied and looked down upon by most of her family. At a young age Adeline is constantly being left behind by her family, leaving her to feel like the unwanted daughter. Throughout the whole novel, Adeline is looked down at and is never acknowledged for her hard work â€Å"Nobody was there to pat my head or congratulate me†¦Ã¢â‚¬  page 17.Adeline’s Father, who is a wealthy businessman, has a small role in the book. This is because Niang seems to be the ‘head of house’. Even by her siblings Adeline is abused or m istreated, â€Å"But then Mama died giving birth to you. If you had not been born, Mama would still be alive. Although Adeline tries her best to please her father and siblings she is continually being rejected by them. Adeline was looked down on and hated by her family, especially by Niang, who was the hardest to please, throughout Chinese Cinderella, it shows that Niang was never happy with Adeline â€Å"You don’t deserve to be housed and fed here. Girls like you should be sent away† page 113. Niang physically abuses Adeline by hitting her, kicking her, slapping her.Adeline is always left miserable, lonely and feeling helpless and afraid. One day, Adeline’s classmates had discreetly followed her home, hoping to give her a surprise party. Instead, they heard Niang beating and screaming at her, â⠂¬Å"Liar! You planned it, didn’t you, to show off our house to your penniless classmates. Although Adeline is a smart girl going to expensive schools, she does not fit in very well with her classmates. Even though it is clear Adeline and her classmates were never really on the same level of friendship. Back in the primary school in Shanghai, Adeline where tried hard to fit in with her classmates, She befriended Wu Chun-Mei who quickly became her best friend, the only one she had during primary. In conclusion all through Adeline’s life Niang shows multiple times through the book that Adeline is not a loved child in her family.

Being a computer whizz, and with the help of his friend who were also hackers, Broderick eventually manages to unearth the backdoor password and starts operating the computer program by running the nuclear war simulation, through his own computer (Franklin, 2008). Considering the threat posed by this computer operation, the simulation scares the whole security and military departments, since it almost causes a full blown World War III, which is a devastating war of nuclear missiles. This cyber crime and security intrusion into the US military department security systems is a form of black hat hacking. This is because, black hat hacking entails the process of violating and cracking computer security systems with malicious intentions of benefitin g oneself (Hanser, 2011). Broderick had been hacking other computer security systems previously, to gain access to computer games that he could play. In the process of searching for more interesting computer games, other than chess, poker and checkers which he had previously accessed, he embarked on searching for new games, which led him to the supercomputer, which seemed to possess a different nature of games than he had been used to (Bischoff, 1983). This practice of hacking into other computer security systems and accessing games to play, instead of purchasing such games from the manufacturers or retailers, is a selfish crime. Additionally, hacking into other security systems without the knowledge of the owners of the systems, regardless of the intentions an individual has, is malicious and damaging (Johnston, 2011). They balance and integrate many elements of piety, devotion, legalism and mysticism and appear to be suitable in co-existing mutually in reinforcing one another (Peters, 1990). Islam has similarity with Judaism in regard to the focus on practice instead of beliefs. The main basis of religious obedience in Islam and Judaism is religious law, while in Christianity the focus is on theology. Across history, the main differences between Islam and Judaism have pertained to disagreement of religious practices and religious law. The disputes between Islam and Christianity have pertained primarily to the divide amongst communities about theological belief systems, relative to the relationships between divine and human characteristics. Christianity and Judaism are given special consideration in Islam in view of the Islamic beliefs that God had conveyed His will through His Prophets, namely Ibrahim, Moses and Jesus. In this regard, the Quran specifically states that God revealed his will throug h Ibrahim, Ismail and their progeny, as well as through Moses and Jesus. There is no difference amongst them and in what they say, which is why Muslims adhere to what was said by these Prophets (Newby, 1996). Islam and the Quran hold that Christians and Jews are Ibrahim’s children and relate to them as people of the book (Esposito, 2011). This is because the three religions originate from the same lineage of Ibrahim. Muslims trace their lineage from Ibrahim and his servant Hagar, while Christians and Jews trace their lineage from Ibrahim and his spouse Sarah. Muslims hold that God’s revelation in the form of the Torah was first delivered to the Jews by Prophet Moses and later to Christians by the Prophet Jesus. Muslims are in agreement about some biblical prophets such as Jesus and Moses and use their names as Isa and Musa respectively (Hipps et al, 2003). They also use the Virgin Mary’s name as Mariam and it is evident that her name appears more frequently in the Quran than in the New Testament. Muslims do not refute the status of Virgin Mary and Jesus’ virgin birth but they hold that in due course, over the centuries, the original revelation as made to Jesus and Moses became despoiled. Muslims view the Old Testament as a mix of human manufacture and of God’s messages. They hold the same views about the New Testament and believe that doctrines referring to Jesus as the Son of God are erroneous without any truth. They do not believe that the death of Jesus represented the redemption and atonement for mankind’s sins. It is apparent that Islam, Christianity and Judaism have some common roots and share several common practices. This is because they are all having the same Abrahamic heritage. Islam, Christianity and Judaism are monotheistic religions as they believe in a single God in focusing on the unity and oneness of God. The confirmation of one God in Christianity has been often debated because of its adherence to the Holy Trinity but this cannot be considered as a refutation of monotheism. It is only an acknowledgement of the ways in which God is viewed because in Christianity the Divine Being is God. Islam, Christianity and Judaism hold that God is the source and foundation of all that exists in the world and takes care of all His creations in ensuring their wellbeing. Ethics in the Oil and Gas Industry INTRODUCTION This report looks at the importance of ethics in the oil and gas business and its potential impact on business risk and company share value. Ethics refers to the concept of what is right and wrong, and ethical behavior is generally considered behavior that is proper. Business ethics is a form of applied ethics that examines ethical principles and moral or ethical problems that arise in a business environment. It applies to all aspects of business conduct and is relevant to the conduct of individuals and organisations. They are the moral values that guide the way corporations or other businesses make decisions. ETHICS AND BUSINESS RISK There are many instances throughout corporate history of how companies have disregarded ethics or morals in the quest for wealth. This can increase business risk due to breaking the law, damaging their image and the effects of lawsuits and damages. Breaking the Law Bribery and corruption are widespread in the developing nations. Companies say that the only way to get things done is to pay the bribes. Although few companies publicly defend bribing officials in third world countries, many privately condone bribery on several grounds. First, there are strictly financial considerations. Bribes can prevent delays that might otherwise have serious financial implications. In a capitalistic environment, we need an even playing field, and if other businesses engage in bribery, then either we do or face being at a competitive disadvantage. Second, there are practical considerations owing to what appears to be the universal nature of bribery in third world countries. Often foreign government officials are so corrupt that it is virtually impossible to do business without playing by the unspoken rules. Thus, theres nothing morally wrong with participating in bribery. On November 4, 2010 the United States Department of Justice announced a series of settlements whereby seven firms were to pay criminal fines and civil disgorgement penalties amounting to a total of $236.5m, in a settlement in relation to the Foreign Corrupt Practices Act. Five of the firms were Royal Dutch Shell, Transocean Inc, Global SantaFe Corp, Pride International and Noble corporation (Thomson Reuters , 2010). This type of transgression if repeated has the potential to place the companies involved at serious risk. It is this acceptance of thats the way the system works that perpetuates and fuels the bribery culture. If all companies adopted a strong ethical position and refused to pay the bribes the corrupt system would fail. Some companies have taken steps to distance themselves from corruption. BP was the first oil company to support the Publish what you pay campaign, a campaign for greater transparency in oil companies dealings with foreign governments. StatoilHydro was the first major oil company to start disclosing ALL revenues and payments in the countries in which it operates. It has set out a clearly defined ethics code of conduct and is promoting this in the different countries it operates in (Statoil, 2008). Damage to Company Image In the 1990s Shell was involved in a highly damaging controversy in Nigeria. The Ogoni people of the Niger delta, a minority tribe, had seen their land decimated by years of drilling. Ken Saro-Wiwa helped form the Movement for the Survival of the Ogoni People, and began protesting. The army ordered a brutal crackdown and series of killings, beatings, and arrests took place. Saro-Wiwa was eventually framed for murder and executed. This event was met with widespread condemnation and the bad publicity surrounding it was extremely difficult for Shell. It is difficult to say if Shell were complicit in these events but they certainly could and should have stopped it or at the very least spoken out against it. Shell eventually distanced themselves from Nigeria in an attempt to regain credibility. Total has been in Burma since 1992 and is a supporter of the military regime. The country has an appalling human rights record. Aung San Suu Kyi, Burmas pro-democracy leader, has said that Total has become the main supporter of the Burmese military regime. She told the French weekly Le Nouvel Observateur that TOTAL knew what it was doing when it invested massively in Burma while others withdrew from the market for ethical reasons. She added, the company must accept the consequences. The country will not always be governed by dictators. (Burma Campaign UK , 2007) However unlike Shell this does not worry nor deter Total Unfortunately, the worlds oil and gas reserves are not necessarily located in democracies says Totals website. Lawsuits and Damages On April 20th 2010 the BP operated Macondo well blew out. The Transocean owned Deepwater Horizon drilling rig was destroyed with the loss of 11 lives. The well continued to leak oil into the Gulf of Mexico until it was finally killed on the 17th September 2010. Initial reports show that cost cutting, poor decision making and lack of honesty were important factors in the disaster. Both companies have suffered damage to their company image, reputation and financial well being. BP initially faced all the blame as this was politically convenient to the point that it suddenly became British Petroleum again after a gap of 20 years which clearly showed that the Obama administration was about as ethically sound as either Transocean or BP. BP safety record in the US is poor but much of this is down to the poor condition of assets it inherited during its mergers with Amoco and Arco. Due to its failure to live up to its ethical promises BP is viewed with mistrust bordering on outright hatred in the US whilst elsewhere ethical investors are shying away from it. Tony Hayward, the former group chief executive of BP, stated: Our reputation, and therefore our future as a business, depends on each of us, everywhere, every day, taking personal responsibility for the conduct of BPs business. Sadly even the chief executive failed to live up to his own statement. ETHICS AND SHARE VALUE The effects of this disaster on BP have been significant with BP as a corporate entity particular at risk. The effect of the Macondo disaster on BPs share price was initially catastrophic. As can been seen in Figure 1, the share price collapsed from 650p/share to 300p/share in a little over 2 months. Figure . BP Share Price April 2010 Feb 2011 chart_builder (Livecharts, 2011) BP has had to pay out an initial  £20 billion in clean-up costs and with civil lawsuits pending, the final pay-out is expected to severely impact on the strength of its business. After announcing that it had successfully capped the Macondo well however BP shares rose 8% (Gray, 2010). This proves that investors with equally as little regard to ethics are buying in at the bottom of the market in the hope of making a profit. There have been other cases where poor ethical behaviour has led to significant declines in share price. In January 2004 Royal Dutch Shell announced that it was downgrading nearly 4 billion barrels of proven reserves to the probable category. As a result Shells share price fell by 7%. An internal report by US law firm Davis, Polk and Wardwell, (Moore, 2004) detailed a damaging series of e-mails showing that top managers at the company had known about the inflated reserves for years and had been arguing about whether and how to lie to investors. Conclusion Which means of ethical behaviour a company adopts has been open to much debate. There are some business leaders who think as Milton Friedman did that their duty is, to make as much money as possible while conforming to the basic rules of the society. Others such as Statoil wish to conduct their business to the highest ethical standards possible. Companies have set up Corporate Social Responsibility policies. These policies clearly state the companies ethical and social stand point. The main problem with this is when individuals fail to live up to the statements Unethical business practices will continue to be seen in the oil and gas sector as some companies continue to think that the lack of ethics will have no impact. In many ways they are correct. Shell and Total do not seem to be struggling despite poor ethical records. From a sales point of view ethics, or the lack of them, have little impact. Due to the very nature of the product the ethical stance of the end user will be weaker. When we buy petrol we dont know where it came from or who suffered as a consequence and so companies are protected. The world is reliant on oil and will therefore look the other way as long as it keeps flowing. If these practices continue it may lead to government intervention and regulations that are more financially costly for companies to adhere to. Even more important than governmental intervention, is trust. Companies lacking trust by employees, business partners, and customers will suffer financially in the long-term. Trust, based on ethical reputations, may become even more important in the future (Richardson, 2002/2003). We live in an age where the general public are more attuned to, and aware of, ethical concerns and will base their investment strategies on these principles. In the computer age information is more easily accessed and campaigns against companies can be organised worldwide in days. Companies basing their corporate strategies on strong ethical principles may not show so much short term gain however their long term security will be assured.

Contempt of Court in Canada Essay -- essays research papers

Introduction This paper is concerned with the common law of contempt of court. More specifically, it outlines the arguments in favour of, and against, codifying this law. The purpose is to discuss problems with contempt of court, and make proposals to restructure the law. The first part of this paper will explain the openness principle, which is the balancing factor in respect of contempt of court. The second part will outline the common law offence of contempt of court and narrow the scope of this paper. The second part will set out and explain the arguments in favour of, and against, codifying the law. Finally, the last part of the paper will set forth some proposals for reform. The Openness Principle Even before freedom of expression was enshrined in our constitution, the judiciary noted that the basic principle governing judicial proceedings in Canada was their openness. Canadian courts are public institutions and accordingly, courtroom occurrences should be public business. As one Supreme Court justice stated, â€Å"openness was to be the rule; covertness the exception.† It was further noted that at every stage of the process, the rule should be one of public accessibility and judicial accountability. Now, since free expression has been espoused by Canadians and enshrined in the Canadian Charter of Rights and Freedoms , the openness principle has attained a constitutional basis. Advancement of the principle is made possible by the media, as news reports are the primary means by which the public obtains information about the courts. Hence, courts must be open to the media in order for them to be open to the public. This concept is not novel to Canada’s judicial system. In fact, in recognition of this notion, the system has allowed media exceptions to certain rules and regulations of the court. A limitation on the openness principle is found in the common law of contempt of court. The underlying foundation of this analysis is that contempt of court must be balanced with the openness principle because accurate and fair courtroom reports are an integral part of the due administration of justice. Contempt of Court, Generally Contempt addresses behaviour, actions, and publications that interfere with, or create a real risk of interfering with, the due administration of justice. It regulates a range of human activities that pose a risk of such interferenc... ...contempt were formed but rejected on the basis that codification would have made an unnecessarily restrictive offence even more restrictive. Then, in 1984, a bill was introduced which would have codified much of the law of contempt. The bill was never enacted and nothing has happened since. The time has come to reconsider these issues as the law is now in dire need of reform. To clarify, this paper is not suggesting that all contempt of court law be codified. That would be an almost impossible task for a paper of this length, given the complexity of this area of law. Instead, the focus has been on sub judice common law contempt, its effect on our rights and freedoms, and the arguments in respect of codification. Balancing the rights and freedoms of Canadians with the administration of justice, the logical step seems to be in the direction of codification. Other jurisdictions, such as the United Kingdom, have taken the positive step toward codification. Perhaps Canada should examine the progress of these jurisdictions, and determine whether their attempts to limit the scope of media restrictions, while protecting the interests involved in trial proceedings, have been successful.

Organization First impressions are crucial. If a classroom is organized and appropriately arranged, then it is apparent that the teacher possesses good management skills. A variety of things must be considered when arranging the classroom. It â€Å"must contain interesting materials appropriate to a child’s stage of intellectual development† and not appear thrown together (Streng, 1978). All fire exits, doorways, and main walkways must be kept open and free of clutter while built in cupboards, drawers, closets, etc must be easily accessible as well. The desk arrangement, perhaps the most important element, requires several considerations. Placing the students desks in groups promotes peer tutoring and collaborative activities. However, they may tend to be more talkative and less focused. Individual seating is effective in keeping students focused and on task, but group work is often difficult and requiring time to move desks. Also, when students are separated from each other they are more dependent on the teacher for understanding since their peers are not as easily accessible. Often pairing students is a good method that promotes peer tutoring and some teamwork but has a better chance of students remaining focused and successful (Glover, 1994). Learning and teaching styles need to be considered, as well as how the classroom should be run, before arranging desks. The teacher’s desk should be strategically placed so all students can be seen and any important areas such as a black board are not blocked. Everyday on the news one hears stories of crimes-murder, robbery, rape, assault, extortion, kidnapping, homicide, an endless list. Law enforcement works day and night protecting neighborhoods and cities from crimes and violence, but the truth of the matter is that crime still exists and all one can do is ask himself why. Why do such treacherous violent acts exist in society? In essence, one must ask himself whether or not these violent tendencies have any biological relation whatsoever. Do violent tendencies occur as an affect of disruptions or damage to the brain? Is there a genetic correlation? Is violence brought about by some other factor, such as economic difficulties or social or cultural differences? All these questions remain unanswered. But one even significant, broader question that one must cons ider is whether or not these factors, biologically related and non, effect the occurrence of violent tendencies in individuals. In 1848, a railroad worker, Phineas Gage, was working when an explosion caused an iron rod to impale his skull, damaging the front part of his brain. Although Gage miraculously survived, his behavior severely changed in that the intelligent and respectful man everyone knew suddenly because fitful, impulsive, and rude (2). This is one of the first dated cases insinuating that violence may be related to some kind of damage or abnormality in the brain.
